This Privacy Policy describes how Stick & Ball (“Stick & Ball,” “we,” “us,” or “our”) collects, uses, and shares your personal information when you visit or make a purchase from stickandball.com (the “Site”).

Natural persons who reside in the State of California should also review the “Notice to California Residents” section below and our opt-out link. Residents of other U.S. states should review “Your Privacy Rights (U.S. States).” Residents of the European Economic Area (EEA) and the United Kingdom should review “EEA and UK Residents.” You may have additional rights under these laws.

Personal Information We Collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. As you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

  • “Cookies” are data files placed on your device, often including an anonymous unique identifier. We use a consent banner to obtain your permission for non-essential cookies. For more information about cookies and how to manage them, visit allaboutcookies.org.
  • “Log files” track actions occurring on the Site and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
  • “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

To display prices in your local currency, a third party may process your IP address to estimate your location, and your selected currency may be stored in a temporary session cookie that is automatically removed when you close your browser. Where required by law, we rely on the consent you provide through our cookie banner for non-essential cookies of this kind.

When you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this as “Order Information.” Payment card information is treated as sensitive personal information and is used only to process your transaction.

When we use the term “Personal Information” in this Privacy Policy, we mean both Device Information and Order Information.

How We Use Your Personal Information

We use the Order Information we collect generally to fulfill orders placed through the Site (including processing payment, arranging shipping, and providing invoices and order confirmations). We also use Order Information to communicate with you, to screen orders for potential risk or fraud, and, when consistent with the preferences you have shared with us, to provide you with information or advertising relating to our products or services.

We use Device Information to help screen for potential risk and fraud (in particular, your IP address) and, more generally, to improve and optimize our Site — for example, by generating analytics about how customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns.

How We Share Your Personal Information

We share your Personal Information with third parties to help us provide the services described above. For example:

We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.

For purposes of California and other U.S. state privacy laws, our use of advertising and analytics partners may be considered a “sale” or “sharing” of personal information (including for cross-context behavioral advertising). You can opt out as described in the “Your Privacy Rights” and “Notice to California Residents” sections below. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Behavioral Advertising

We use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Opt-Out Preference Signals (Global Privacy Control)

We recognize and honor the Global Privacy Control (“GPC”) and other opt-out preference signals as a valid request to opt out of the sale and sharing of personal information for the browser or device from which we receive them. When we receive such a signal, we will treat it as an opt-out for that browser or device and, where applicable, for the associated account, and we will confirm on the Site that the request has been processed.

Do Not Track

Some browsers offer a “Do Not Track” (“DNT”) setting. Because there is currently no industry standard for how to respond to DNT signals, we do not respond to DNT signals at this time. We do, however, honor Global Privacy Control signals as described above.

Your Privacy Rights (U.S. States)

Depending on where you live, you may have some or all of the following rights regarding your Personal Information:

  • The right to know and access the Personal Information we have collected about you;
  • The right to correct inaccurate Personal Information;
  • The right to delete Personal Information;
  • The right to opt out of the sale or sharing of your Personal Information and of targeted advertising;
  • The right to limit the use of sensitive Personal Information;
  • The right to data portability; and
  • The right not to receive discriminatory treatment for exercising these rights.

Notice to California Residents

If you are a California resident, you have the rights described above under the California Consumer Privacy Act, as amended by the California Privacy Rights Act. To opt out of the sale or sharing of your personal information, you can use the privacy opt-out link in the footer of our website (labeled “Your Privacy Choices” or “Do Not Sell or Share My Personal Information”), send us a Global Privacy Control signal through your browser, or email us at info@stickandball.com. To limit the use of your sensitive personal information, contact us using the details below. We will confirm when we have processed your opt-out request, and we will not discriminate against you for exercising your rights.

EEA and UK Residents

If you are located in the European Economic Area or the United Kingdom, the data controller of your Personal Information is our CTO located at 177 E. Blithedale Ave., Mill Valley, CA 94941, United States. You may contact us at info@stickandball.com.

We process your Personal Information on the following legal bases: to perform a contract with you (for example, when you place an order); for our legitimate business interests (such as fraud prevention and improving our Site); to comply with legal obligations; and, where required, based on your consent (for example, for non-essential cookies and certain marketing).

You have the right to access your Personal Information; to request that it be corrected, updated, or erased; to restrict or object to our processing; to request data portability; and, where processing is based on consent, to withdraw that consent at any time. You also have the right to lodge a complaint with your local data protection supervisory authority.

Please note that your information will be transferred outside of Europe, including to the United States and Canada, and processed there. Where required, we use appropriate safeguards for such transfers.

Data Retention

We retain your Order Information for our records for as long as necessary to fulfill the purposes described in this Policy — including to satisfy any legal, accounting, tax, or reporting requirements — unless and until you ask us to delete it, after which we will delete it unless we are required to retain it by law.

Children’s Privacy

The Site is not directed to children, and we do not knowingly collect Personal Information from children. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Changes

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons. We will review this Policy at least every 12 months and update the “Last updated” date above when we make changes.
